A judge has approved a settlement between the owner of Jupiter's Harbourside Place and the family of a man who was electrocuted in the fountain at the shopping and dining complex.

45-year old Nate Davenport was killed while trying to rescue his children who had climbed into the fountain in front of the stage at Harbourside in October.

The Town of Jupiter says the light fixtures in the fountain were leaking electrical voltage into the water.

The man's widow filed a wrongful death lawsuit against Harbourside Place and eventually reached an out of court settlement in March.

A judge held a hearing on Thursday to verify that both parties agreed to the terms and granted the motion to accept the settlement. The terms have been kept private.

Another lawsuit was filed in February by a man who says he was shocked by the fountain while attempting to help pull Davenport and his kids from the water.
